1. The Respondent most respectfully submits that the Claimant's claim for liquidated damages proceeds on an incomplete and misleading account of the project timeline. The infrastructure services agreement required coordinated approvals, staged access to work fronts and timely release of running bills. Material delay in grant of approvals and restricted access to critical work areas materially impeded the Respondent's mobilisation and execution programme.

2. Without prejudice, it is submitted that the Claimant withheld substantial running payments despite approved work and accepted milestones. The resulting cash-flow constraints directly affected labour deployment, procurement and subcontractor continuity. Any period of slow progress attributable to non-payment or delayed bill approval cannot fairly be laid at the Respondent's door for the purpose of liquidated damages.
